Our Lifetime Workmanship Warranty is our way of standing behind that promise — giving you complete confidence that our craftsmanship will perform as beautifully years from now as it does the day it’s installed.

What’s Covered

Labor to repair or correct any workmanship mistake made by Memphis Water Gardens employees on the specific project named in your contract.

All work performed to accepted industry standards and Aquascape Certified Contractor best practices.

What’s Not Covered

Products, materials, or plants (these are covered by their respective manufacturers or suppliers).

Damage caused by lack of maintenance, neglect, third parties, wildlife, acts of God, vandalism, or any other forces beyond our control.

Any alterations, modifications, or additions made after the original installation.

Customer Responsibilities

Follow reasonable pond and water feature care practices, including regular cleaning, water quality management, and landscaping upkeep.

Keep maintenance records and provide them upon request.

Submit warranty claims in writing within 30 days of noticing a problem to sales@memphiswatergardens.com.

Allow MWG reasonable access to inspect the project before any repair work begins.

How Long Does It Last?

Coverage continues for the serviceable lifetime of the original installation while Memphis Water Gardens remains in business.

The warranty ends if the project is altered or if MWG ceases operations.

Our Options

At our discretion, we may repair, replace, or refund the labor portion related to the workmanship issue.

Any materials, permits, equipment rentals, or third-party services required to complete the repair will be billed to the owner at current rates.

Transferability

The warranty may be transferred to a new property owner if MWG is contacted in writing within 90 days of the property transfer and all maintenance and care requirements have been met.

Limits

MWG’s liability is limited strictly to the labor we performed.

We are not responsible for any consequential, incidental, or indirect damages.

This warranty is governed by the laws of Tennessee, and any disputes will be resolved through arbitration in Shelby County, TN.

1. Scope of Workmanship Coverage

This Lifetime Workmanship Warranty covers only the labor performed by Memphis Water Gardens (“MWG”) employees in repairing, replacing, or restoring any mistake made by MWG in connection with the designated project.

This Warranty applies exclusively to workmanship — it does not extend to any products, materials, or plants, which are covered solely under the warranties of their respective manufacturers or suppliers.

All plants installed, moved, or modified by MWG are specifically excluded from this Warranty.

2. Duration of Coverage

Coverage begins upon final project delivery and full payment for the designated project.

This Warranty remains valid for the serviceable lifetime of the project, provided that:

  • The original installation remains unaltered from its condition at completion; and
  • MWG remains in active business operations.

 

If MWG ceases operations, this Warranty automatically terminates. All past and present owners, officers, and agents of MWG are then absolved of any responsibility or obligation under this Warranty.

3. Standards of Workmanship

MWG guarantees that all workmanship will:

  • Follow commonly accepted industry practices and material standards at the time of installation; and
  • Adhere to the installation methods and best practices prescribed by Aquascape Inc., as MWG is a Certified Aquascape Contractor.

4. Exclusions and Limitations

This Warranty does not apply to, and MWG is not liable for, any damage, defect, or failure resulting from:

  • Negligence, improper maintenance, or lack of reasonable care by the Owner or others
  • Acts of God or “Force Majeure” events, including wildlife, pets, vandalism, fire, flooding, extreme weather, or other natural disasters
  • Changes to the terrain, drainage, landscaping, or surrounding property by the Owner or others
  • Any service, modification, or repair performed by someone not authorized by MWG

 

MWG’s liability under this Warranty is strictly limited to the labor necessary to repair or replace defective workmanship. MWG will not be responsible for any consequential, incidental, or indirect damages.

In no event shall MWG’s total liability exceed the original contract price paid for the workmanship covered under this Warranty.

5. Maintenance Requirements

This Warranty remains valid only when the project is maintained under reasonable and consistent care. Reasonable maintenance includes, but is not limited to:

  • Following standard pond and water feature care practices
  • Performing regular cleaning and pump and filter maintenance
  • Maintaining proper water quality and chemical balance
  • Managing landscaping, drainage, and nearby trees to prevent damage

 

The Owner must retain maintenance records for all work performed by anyone other than MWG and provide those records upon request. Failure to maintain or produce documentation may void this Warranty.

6. Claims Procedure

To file a claim under this Warranty, the Owner must submit the request in writing within thirty (30) days of discovering the issue. Claims should be sent by email to:

The Owner must allow MWG reasonable access to inspect the project before any repairs are made.

At MWG’s discretion, the company will repair, replace, or refund the labor portion related to the defective workmanship.

All materials, equipment rentals, permits, or third-party services required to complete a repair are excluded and will be billed to the Owner at current rates.

MWG also reserves the right, at its sole discretion, to partially apply this Warranty while excluding other elements from coverage, with a full written explanation provided to the Owner.

7. Transfer of Warranty

This Warranty may be transferred to a new property owner if the following conditions are met:

  • The new owner notifies MWG in writing within ninety (90) days of the property transfer; and
  • The project continues to meet all maintenance and care requirements outlined in this document.

 

Failure to register the ownership transfer within the stated period voids this Warranty unless specifically approved in writing by an authorized MWG representative.

8. Governing Law and Venue

This Warranty and any related disputes shall be governed by the laws of the State of Tennessee.

All disputes must be resolved exclusively through arbitration in Shelby County, Tennessee, in accordance with the Tennessee Uniform Arbitration Act.

9. Severability and Entire Agreement

If any clause or portion of this Warranty is deemed invalid or unenforceable, the remaining sections shall remain in full force and effect.

Minor inaccuracies or typographical errors do not alter the meaning or enforceability of this Warranty.

This document constitutes the entire agreement between MWG and the Owner regarding workmanship. No representative or employee of MWG has authority to modify this Warranty orally or to extend any additional warranties.
